On September 25, a man with a history of threatening law enforcement officers was arrested by Flagler County Sheriff’s Office deputies and the Bunnell Police Department for kicking a man out of a vehicle, being involved in a hit-and-run with injuries, and leading deputies and officers on possibly the slowest chase in FCSO history.
The victim, kicked out of the vehicle, was a passenger in a black Kia Sorento driven by Kyle McNary, 33, near the intersection of East Woodland Street and State Road 100. The victim stated McNary wouldn’t drive faster than 15 to 20 miles an hour. Eventually, McNary stopped to switch places so the victim could drive. Instead, McNary ran into the street and started waving at cars passing by. The victim said he eventually corralled McNary in the passenger seat but as the victim was getting in the driver’s seat, McNary kicked him out, jumped back into the driver’s seat and “sped” off, leaving the victim on the side of the road. A good Samaritan stopped to help the victim and let him sit in their car until law enforcement arrived. The victim said he was uninjured and declined medical attention.
As McNary left the victim on the side of the road, he drove to the intersection of U.S. Route 1 and Otis Stone Hunter Road where he was involved in a hit-and-run with injuries. The victim of the crash told deputies the SUV McNary was driving came to a complete stop in front of the vehicle she was riding in, not giving the driver enough time to stop. As a result, the vehicle collided with the rear of McNary’s SUV.
McNary was quickly spotted by FCSO deputies and BPD officers on U.S. 1 driving slowly. Both agencies tried to conduct a traffic stop, but McNary kept driving away. Deputies used stop sticks to deflate one of the tires on the SUV, but McNary continued to try and get away, at this point traveling at two to three miles per hour. McNary made several U-turns across the median and eventually the SUV got stuck in a ditch on the side of the road.
In the pouring rain, several deputies exited their patrol vehicles and began giving McNary loud and clear verbal commands over the public address system, which McNary ignored. After a period of time, three deputies approached the SUV and used a Shatterball to breach out a rear window to gain visibility inside the vehicle, which was hindered due to the heavy rain. McNary began complying with lawful orders and exited the vehicle, walking toward deputies with his hands up and then laid on the ground to be placed in handcuffs.
McNary was arrested for Simple Battery, Failing to Stop/Remain at a Crash Involving Serious Bodily Injury, Fleeing and Eluding Law Enforcement, Obstruction without Violence, Battery on a Law Enforcement Officer, Resisting a Law Enforcement Officer with Violence – Aggravated Assault, Assault on a Law Enforcement Officer, and Threat with Death or Serious Bodily Harm. He was also arrested by BPD for Domestic Battery. McNary was taken to the hospital for a medical complaint before being transported to the Sheriff Perry Hall Inmate Detention Facility, where he is being held without bond.
This isn’t the first run in with FCSO deputies for McNary. On August 29, deputies were on a call involving McNary, and during this incident McNary swung at a deputy causing the deputy to utilize a takedown technique to try and control McNary. While on the ground, McNary continued to fight with the deputy and kicking him. In this case, McNary was also taken to the hospital and while there and handcuffed to a bed, McNary threatened to fight all law enforcement officers. When McNary was discharged from the hospital, and deputies went to uncuff him from the hospital bed, McNary tried to bite a deputy. He then stood up in the bed and resisted being placed in handcuffs. Deputies were eventually able to get him back down on the bed and place his hands in handcuffs. While being transported to SPHIDF, McNary yelled racial slurs at the deputy and threatened his life.
“This dirtbag has a history of threatening and attacking Deputy Sheriffs, and during his recent criminal act he seriously injured a person in a crash, and we wish them a speedy recovery,” said Sheriff Rick Staly. “But for McNary it looks like he needs an extended stay at the Green Roof Inn. This guy needs to be locked up, so he doesn’t injure anyone else or kill someone with his actions.”
