Flagler County Sheriff’s Office deputies made 22 arrests over Labor Day weekend between 6 p.m. on Friday, August 29, 2025, and 6 a.m. on Tuesday, September 2, 2025. Deputies handled 1,233 calls for service and made 252 traffic stops.

Labor Day Weekend Traffic Enforcement Leads to Arrest of Super Speeder

On Sunday morning, a deputy conducting traffic enforcement on North Ocean Shore Boulevard in Palm Coast observed a silver BMW travelling at a high speed. According to the deputy’s radar, the BMW was travelling 90 mph in an area with a posted speed limit of 35 mph. Additionally, the deputy watched as the BMW passed multiple other vehicles in a no-passing zone.

Due to the reckless driving they observed, the deputy conducted a traffic stop. During the stop, they spoke with the driver, identified as Justin Busam, 50, of Palm Coast. When asked the reason for his speed and passing cars, Busam stated to the deputy that he did not need to explain his actions.

Deputies arrested Busam for dangerous, excessive speeding, and reckless driving – first offense. He was transported to the Sheriff Perry Hall Inmate Detention Facility, where he was later released on a $300 bond.

Under Florida’s new “super speeder” law, speeding more than 50 mph above the posted speed limit or over 100 mph in any circumstance is a crime with a punishment of up to 30 days in jail, a $500 fine, or both upon first conviction.

“With a busy Labor Day weekend, we warned drivers that we would be out in full force targeting aggressive driving. This guy obviously didn’t listen, because travelling 55 mph over the speed limit is absurd and reckless,” said Sheriff Rick Staly. “Even worse, he was doing this on a busy road along the beach that had a lot of foot traffic because people were enjoying the holiday weekend. He’s lucky his actions didn’t seriously hurt or kill someone.”

Two Arrested on Multiple Charges During Traffic Stop

On Monday afternoon, a deputy conducting traffic enforcement on Interstate 95 in Palm Coast was alerted that the registered owner of a red Chevrolet in the area had a suspended driver’s license since January 2025.

The deputy located the vehicle and conducted a traffic stop. During the stop, the deputy identified two occupants: Cunningham, 23, of Plantation, Florida, who was the driver of the vehicle, and Jean Garcia, 22, of Miami, who was in the passenger seat. Based on Cunningham receiving a recent citation for driving while her license was suspended without knowledge, the deputy determined that she was aware she had a suspended license and should not have been driving.

While speaking with Cunningham, deputies noticed the smell of marijuana coming from the vehicle. During a vehicle search, deputies found a small plastic bag hanging from the passenger seat containing a white powder, which later tested positive for fentanyl; a glass jar containing marijuana and a grinder in the center console; and a vape pen containing THC between the center console and passenger seat.

Deputies arrested Cunningham for driving while his license was suspended with knowledge, possession of fentanyl, possession of hashish, possession of marijuana (20 grams or less), and possession of drug paraphernalia. Deputies also arrested Garcia, who had a handgun in his waistband during the stop, for possession of a firearm during the commission of a felony, possession of fentanyl, possession of hashish, possession of marijuana (20 grams or less), and possession of drug paraphernalia.

“This driver knew she should not have been driving because she couldn’t seem to keep her license valid, but decided to drive anyway,” said Sheriff Staly. “The risk wasn’t worth it, because she not only has to face the consequences of that decision, but she and her passenger also picked up multiple felony charges after deputies found drugs in their vehicle. They should have enjoyed Labor Day weekend at home instead of driving around with illegal narcotics and a gun.”

Both were transported to the Sheriff Perry Hall Inmate Detention Facility. Garcia was released on a $3,500 bond, while Cunningham remains held on a $3,500 bond.
