The Flagler Home Builders Association (Flagler HBA) has served a 14-day Notice of Violation against the City of Palm Coast, taking the first step toward legal action over what the Association asserts are violations of Florida
Senate Bill 180 and the Florida Impact Fee Act.
The Flagler HBA alleges that the City unlawfully adopted three separate impact fee increases which more than double the impact fees on homes and businesses from a minimum of $5,764 (previously) to $11,646 as of October 1, 2025. This brings the impact and utility fee total for a 2,000 square foot home to no less than $31,528. The Ordinances are in violation of both Florida Statute and Florida Supreme Court precedent. They also exceed the state’s statutory limit of 50%, impacting fees related to fire and rescue, parks and recreation, and transportation.
“We believe the notice of violation accurately states the law as well as the defects and deficiencies of these ordinances,” said Annamaria Long, Executive Officer of the Flagler Home Builders Association. “We are committed to protecting citizens and ensuring a fair business environment in our community.”
The FHBA’s action is supported by both the Florida Home Builders Association and the National Association of Home Builders (NAHB). Together, these organizations represent more than 140,000 members nationwide who design, construct, and remodel the majority of single- and multi-family homes built each year.
The lawsuit will argue that the City’s fee increases lack the required nexus to new development and violate state law, creating an unnecessary burden on residents, businesses, and potential homeowners.
