Recently, headlines were made when the current Mayor of Palm Coast filed his lawsuit against the City of Palm Coast, regarding the appointing of District 4’s representative Councilman Charles Gambaro. Many residents have been following this lawsuit, some questioning how many other lawsuits are currently active against the city. According to the Flagler County Clerk of Court’s records, there are three active lawsuits where the City is the defendant for nonproperty-related civil issues. The lawsuit filed by Mayor Norris, found here, a lawsuit against the City filed by former Utility Director Amanda Rees, found here, and a third where two residents are currently suing the City for injuries sustained during a fall on a City trail/sidewalk near Palm Harbor, found here. The City is still in active litigation as the plaintiff in a case regarding James F. Holland Park, and the public can review the proceedings as they have progressed here.
The lawsuit filed by the mayor over Councilman Gambaro’s seat has drawn an abundance of attention from many within and without the city. In another recently filed lawsuit, former Utility Director Amanda Rees has filed a suit against the city due to the nature of her dismissal. A third lawsuit recently filed against the city was filed on behalf of two residents who, according to their complaint, were walking on a pathway that was not properly maintained near Palm Harbor. This led to injuries for the plaintiffs, and according to their complaint, they are suggesting that the city has waived their Sovereign Immunity. The litigation surrounding the splash pad at James F. Holland Park in Palm Coast has been ongoing since late November 2022. This case is currently active, where the City of Palm Coast is seeking damages from multiple contractors and parties. This case has been lengthy, from beginning to end, with the initial complaint filed by the city reaching 181 pages. The suit has been lengthy, and just recently on 6/5/2025, a proposed order granting the motion for an extension of time was filed through the court.
