Several Citizens “See Something, Say Something,” Leading to DUI Arrests of Very Impaired Drivers
Flagler County Sheriff’s Office deputies made 54 arrests this past weekend between 6 p.m. on Friday, June 28, 2024, and 6 a.m. on Monday, July 1, 2024. They handled 685 calls for service and made 261 traffic stops.
Drunk Driver Arrested in Palm Coast After Citizens “See Something, Say Something”
On June 29, numerous concerned citizens called 9-1-1 stating a white Chevrolet truck was driving recklessly, running the red light at the intersection of Palm Coast Parkway and Old Kings Road. One witness advised that she saw a Silverado swerving out of its lane of travel multiple times, and it appeared the driver, described as a short Hispanic male, was completely unaware of his surroundings as though there was no one else on the road.
Deputies located the vehicle several minutes later in the Red Roof Inn parking lot. A male matching the description was observed sleeping in the driver’s seat with the vehicle running. Deputies woke him up and he was fumbling. While speaking to the male, one of the deputies observed that the subject appeared to be looking straight through him with glassy eyes.
After obtaining his Mexico ID card, the driver was identified as Miguel Calvillo Vivanco, 37, and he did not have a valid driver’s license in the U.S.
During the investigation, Cavillo Vivanco lost his balance and almost fell while attempting to sit in the back of the patrol unit and refused to provide a sample of his breath or take a field sobriety test to determine his alcohol content.
He smelled of alcoholic beverages, his eyes appeared glossy, and his speech was slurred. Calvillo Vivanco was arrested for Operating a Motor Vehicle without a Valid License and DUI and was taken to the Sheriff Perry Hall Inmate Detention Facility. While at the jail, he refused to submit to the required breathalyzer test. He posted $1150 bond and was released.

“This guy is likely in this country illegally, driving without a license drunk, who could have seriously hurt or killed someone,” said Sheriff Rick Staly. “I want to thank everyone who called in and reported this drunk driver and helped us keep our roads safer. Let this be a message – Don’t drive drunk. If you do you will see the bars at the Green Roof Inn.”

“See Something, Say Something” Leads to Traffic Crash and DUI Investigation, Resulting in Arrest
On June 30, deputies responded to Tractor Supply located at 250 Belle Terre Parkway, Palm Coast, in reference to a crash involving a possible impaired driver.
Upon arrival, Master Deputy Rainey located a black Volkswagen SUV being driven by a male, later identified as Mariano Jean Apollon, 38, of Daytona Beach. The odor of an alcoholic beverage was detected from inside the vehicle and from his breath. He appeared impaired, with glossy and bloodshot eyes. When questioned, his responses were difficult to understand, due to him covering his mouth, mumbling, and slurring his words. When asked to exit his car, deputies observed him stumbling and using the Volkswagen as support when walking.
A witness, who had initially seen him enter the parking lot, reported that his SUV pulled into a parking spot and hit a parked Corvette. He then backed-up and pulled back into the parking spot and almost hit the vehicle of the witness.
At the conclusion of the traffic crash investigation, deputies then began conducting a Driving Under Influence (DUI) investigation. Apollon declined participation in Standardized Field Sobriety Exercises and was arrested for DUI.
During the investigation, two Four Loko cans were observed on the floorboard of the Volkswagen, one of which was unopened and the other open and half empty. Apollon stated that he began drinking at 1:00 a.m. and had several Four Loko drinks. Mariano also advised he was headed to the store to purchase more alcohol. Additionally, he was aware of his license being suspended for a prior DUI from Volusia County. A further check on his license revealed numerous prior DUI convictions and Driving With License Suspended or Revoked (DWLSR) charges.
Apollon was arrested for Driving While License Suspended (DWLS) w/ Knowledge 1st and 2nd Offense, DUI and taken to the Sheriff Perry Hall Inmate Detention Facility. At the jail he Refusal to Submit to Testing.

“Here’s another great example of how a concerned citizen ‘saw something and said something’ before someone else could get hurt or killed, or more property could get damaged by this selfless drunk,” said Sheriff Staly.

Proactive Patrols Result in Arrest for Driving with Suspended License, Hydrocodone
On June 28, Cory Waring, Jr., 29, of Palm Coast was arrested after a traffic stop led to the discovery of an opioid in his possession and a driver’s license that had been suspended since 2022.
Deputies observed a black Hyundai SUV making an improper turn on Highway 100 and the registered owner and possible driver as having a suspended driver’s license since September 2022. Deputies followed the vehicle, observed other traffic violations, and conducted a traffic stop at 11 Market Ave (Dollar General).
During the investigation, a white pill inscribed M367, which was identified as Acetaminophen and Hydrocodone Bitartrate 325 mg / 10 mg, a Schedule 2 controlled substance, was found in his wallet. Located in the center console was a white plastic spoon with a clear plastic baggie wrapped around the head of the spoon containing a white powder-like substance. The substance was field tested as cocaine.
Waring was arrested for Possession of Hydrocodone, Drug Paraphernalia, and DWLS w/ Knowledge 2nd Offense. He posted $3500 bond and was released from the jail.
